Terms of Service

Welcome to the Luminous Talent Network platform. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the platform.

1. Eligibility

You must be at least 18 years of age to create an account and use the platform. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into binding agreements.

2. Account Registration

• You must provide accurate, current, and complete information during registration;
• You are responsible for maintaining the security of your account credentials;
• You are responsible for all activity conducted through your account;
• You may not share your account credentials with others or create multiple accounts to circumvent platform restrictions.

3. Platform Services

The Agency operates a platform that connects Clients with Talent for booking purposes. The Agency acts as a facilitator and booking agent, not as an employer or producer. The Agency is not a party to the creative or production relationship between Clients and Talent, except as the booking agent.

4. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose;
• Harass, threaten, or harm any other user;
• Post false, misleading, or fraudulent information;
• Use content from the platform in violation of the Model Release or usage terms agreed for any production;
• Attempt to circumvent booking fees or payment processing by transacting directly with Talent or Clients introduced through the Agency;
• Reverse engineer, scrape, or interfere with the platform's operation;
• Upload viruses, malware, or other malicious code;
• Impersonate another person or entity.

5. Bookings & Payments

All bookings are subject to the Client Booking Agreement, which governs payment terms, cancellation, and related matters. Payments are processed through Stripe. The Agency collects a 20% non-refundable booking fee as part of the total Rate; the remaining balance is remitted to the Talent upon completion of the engagement.

The Agency reserves the right to withhold Talent payments in the event of a disputed booking, pending resolution.

6. Content & Intellectual Property

Talent profiles, portfolio images, and other content displayed on the platform remain the property of their respective owners. Usage rights for content created during bookings are governed solely by the Model Release executed for each production. Users may not download, copy, or redistribute platform content without permission.

The Agency retains ownership of the platform's design, software, and branded content.

7. Disclaimers

The platform is provided "as is" and "as available," without warranties of any kind, express or implied. The Agency does not guarantee that bookings will result in specific creative outcomes, that Talent will be available for every requested date, or that the platform will be uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, the Agency's total liability for any claim arising out of or related to the platform shall not exceed the total amount of fees paid by the user through the platform in the preceding twelve (12) months. The Agency shall not be liable for indirect, incidental, consequential, special, or punitive damages.

The Agency is not liable for the conduct of Talent, Clients, or their personnel, including but not limited to harassment, unsafe conditions, breach of contract, or unlawful acts committed during or outside of productions.

9. Indemnification

You agree to indemnify and hold harmless the Agency, its officers, and agents from any claims, damages, or expenses arising out of your use of the platform, your breach of these Terms, or your violation of any law or third-party rights.

10. Account Suspension & Termination

The Agency may suspend or terminate any account that violates these Terms, the Production Safety Policy, the Nudity Policy, or any other Agency policy. The Agency may also terminate accounts that are inactive for an extended period.

You may request account deletion at any time through the Support Ticket feature.

11. Governing Law

These Terms shall be governed by the laws of the jurisdiction of the Agency's principal place of business. Any disputes shall be resolved in accordance with the dispute resolution provisions of the Client Booking Agreement.

12. Changes to These Terms

The Agency may update these Terms from time to time. Material changes will be communicated through the platform or by email. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
